Privacy Policy

This Privacy Policy describes how Brabbletv.com, LLC (“Brabble” or “us”), collects, uses and shares personally identifiable information (“PII”), such as your name, address, email address and date of birth, that it obtains from individuals located in the United States in connection with their use of the Brabble software program (the “Software”), the Brabble website located at www.brabble.com (the “Site”) and the Brabble Service. The term “Brabble Service” refers to the Software, the Site, their contents as well as related software applications, plug-ins, and other services and applications available on the Site. We will not affirmatively notify users of changes in our Privacy Policy; but we will abide by the Privacy Policy in effect at the time we collect PII from a visitor, respecting uses of that PII. Brabble is committed to the safety of children. Children under the age of 13 may not register or participate in any of the Brabble Services. If children under 18 elect to register for any of the Brabble Services, they should ask a parent for permission before sending any information to the Brabble Service. We will not request or knowingly collect any PII from a child under 13.

By using the Software, the Site or any other part of the Brabble Service you agree to and accept the terms of this Privacy Policy.

Collection of PII by Brabble

When you register with the Brabble Service, you provide us with certain personal information, such as your name, email address, a user name, password, date of birth and gender. If you purchase any of the services offered on the Site, you will also provide us with your credit card information and billing address.

When you use the Software, we automatically collect information regarding your mobile device, such as mobile phone number, device type, operating system version, mobile carrier and connection type, analytic usage data (for example, screen swipes and touches) and data relating to any Software crashes.

If you OPT IN, we may also access and use the address book, contact lists or other similar items contained in the devices to which you have downloaded the Software for purposes of your use of the Brabble Service.

When you enter the Site, we collect your browser type and IP address, referring web page and pages visited. We also store certain information from your browser using cookies and web beacons, which allow Brabble to identify, among other things, whether you are a new visitor or a returning visitor, and to remember your preferences (for example, which media player you use or your password). Cookies and web beacons also may help Brabble monitor site usage and traffic so we can better configure the site for visitors’ needs. Although we may record information about your usage and associate that information with you, PII will not be collected by or stored on a cookie or web beacon.

Unless and until you OPT OUT, Brabble may record geolocation data identifying the location from where you access the Brabble Service, if available, and will publish your location in your Brabble profile and Brabbles.

If you voluntarily disclose any PII or other information or content for public posting on your Brabble profile or otherwise within the Brabble Service, it will become publicly available and can be collected and used by others.

You post any content on the Brabble Service at your own risk. Even though we allow you to set privacy options which limit access to your Brabble profile and Brabbles, please be aware that no security measures are perfect or impenetrable. In addition, we cannot control the actions of other users with whom you may choose to share your personalized page or your password or log in information. Therefore, we cannot and do not guarantee that content you post on the Brabble Service, even if designated as private, will not be viewed by unauthorized persons. We are not responsible for any circumvention of any privacy settings or security measures contained on the Brabble Service. You understand and acknowledge that, even after removal, copies of any content you post to the Brabble Service may remain viewable in cached and archived pages or if other users have copied or stored your content.

Use of PII by Brabble.

We may use PII to send you notifications about new services offered by Brabble. We may use your PII to address you personally throughout your visit at Brabble and to otherwise provide personal services to you. We may use PII for internal purposes to better understand the use of the Brabble Service and how to make your use easier and more enjoyable. Brabble may also use your name and/or email address for customer service purposes, to send you news about the Brabble Service and for non-marketing or administrative purposes (like notifying you of major changes to the Brabble Service).

Your name, user name and other information that you choose to provide for your Brabble profile page will be displayed to other users of the Brabble Service on your Brabble profile page and will be displayed as part of communications and/or content that you send (referred to on the Brabble Services as “Brabbles”) and viewable at the same level (for example, private, selected Brabble users only, public) that you have selected to be able to view your Brabbles. Those users will be able to contact you through those Brabbles.

We do not use your PII to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to OPT IN or OPT OUT. We may, however, use Brabbles that you have shared publicly on the Brabble Service in member communications, such as newsletters, and advertising and promotion for the Brabble Service.

Use of PII by Third Parties.

Brabble uses third party APIs to distribute Brabble content to other social media platforms, websites and services (for example, Twitter). We will not share your PII with third parties unless and until you OPT IN to these APIs and elect to share specific Brabbles with these third parties.

Unless and until you OPT OUT, Brabble may send you opportunities to participate in offers made by Brabble and Brabble’s business partners and advertisers.

When you give us information for a specific purpose, we will use that information solely for that purpose unless we tell you otherwise and give you an opportunity to OPT OUT. We may also share your PII with third parties who provide support for the internal operations of our website and who will not disclose or use that information for any other purpose, with a third party in the event of a transfer of ownership or assets, or bankruptcy, by Brabble’s owners, or as required or permitted by law, to protect the interests or safety of Brabble or a third party, or in an emergency situation.

We may share with third parties aggregated non-personal information, which might include, for example, how many visitors watched a video or clicked on a specific advertisement. Such information does not identify you personally, however, and is not PII.

Linked Websites.

The Brabble Service might contain links to websites operated by third parties. We are not responsible for the privacy practices of other websites or of third parties that advertise on the Brabble Service. We encourage you to be aware when you leave the Software or the Site and to read the privacy policies of each and every website that collects PII. This privacy policy only applies to PII collected by us on the Brabble Service.

Third Party Advertisers.

Brabble allows other companies to place advertisements within the Brabble Service. These third party advertisers use technology to send, directly to your browser, the advertisements and links that appear on the Brabble Service. These third party advertisers automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see.

Internal Security.

We use commercially reasonable administrative, technical, personnel and physical measures to safeguard PII in our possession against loss, theft and unauthorized use, disclosure or modification. However, no safeguards or data transmissions over the internet are 100% secure and we cannot ensure in all circumstances the security of information you transmit to Brabble. You do so at your own risk.

International Visitors.

The Brabble Service is hosted in the United States. If you visit the Brabble Service from the European Union or other areas outside the United States with laws governing data collection that differ from the laws of the United States, please understand that you are transferring your PII outside of those jurisdictions to the United States for the uses identified in this Privacy Policy. By providing your PII, you consent to that transfer.
